End User License Agreement (EULA)
These terms apply to every Toyamato product, paid or free. The same text is included in the PDF manuals.
1. Parties and scope
This End User License Agreement (“EULA”) is an agreement between you (“the user”) and the author of the Toyamato software (“the author”, Toyamato Forex World, contact: toyamatoforexworld@gmail.com). It applies to Toyamato X EA, Toyamato Breakout Zone, Toyamato Helper and Toyamato Account Guardian, including the demo versions, the PDF manuals and any updates (together “the software”). By downloading, installing or using the software you accept this EULA. If you do not accept it, do not install or use the software.
2. Purchase
The paid versions are sold through Gumroad, which acts as the seller (merchant of record) and handles the payment, the invoice and the applicable VAT under its own terms. This EULA governs the use of the software itself.
3. License grant
For a paid version, the author grants you a personal, non-exclusive, non-transferable, non-sublicensable and perpetual license to use the software on the 2 MetaTrader account numbers (live or demo) that you entered at checkout. You may run it on any number of charts of these 2 accounts and on any number of your own computers or VPS. The 2 account numbers cannot be changed later; a different account requires a new license. The license key is personal and must be kept confidential.
The demo versions may be used free of charge for 10 days on any account and without time limit in the Strategy Tester, for evaluation only. Toyamato Helper and Toyamato Account Guardian may be used free of charge on any account.
4. Restrictions
You may not: share, publish, sell, rent, lend or give away the software, the license key or the download links; use the software on accounts other than the licensed ones; decompile, disassemble, reverse engineer, modify or create derivative works of the software, or remove or bypass the license check or the demo limits; or use the software in any way that breaks the law or the terms of your broker. Free tools may be shared only in the original, unchanged form as downloaded from ToyamatoForexWorld.com.
5. Ownership
The software is licensed, not sold. All rights, title and copyright in the software, the manuals, the logos and the name “Toyamato” remain with the author. Everything not expressly granted in this EULA is reserved.
6. Online license check
The paid software checks the license key online at Gumroad when it starts and once a day, and compares your MetaTrader account number with the account numbers stored with your purchase. For the indicator, this check is done by the free Toyamato Helper. An internet connection and the WebRequest permission in MetaTrader are required. See the Privacy policy.
7. Updates and support
Updates, new versions and support are provided at the author's discretion and are not guaranteed. The author may change or discontinue the software at any time.
8. Refund
A 7-day refund applies if the software does not work technically on your MetaTrader (an installation or activation problem that cannot be solved together, or the wrong platform purchased). Trading results and losses, and wrongly entered account numbers, are not a reason for a refund. When a refund is issued, the license key is deactivated. Your statutory consumer rights are not affected.
9. Risk and no advice
Trading forex and CFDs involves a high risk of loss. The software is a tool, not a holy grail, and not financial advice. Backtests and demo results do not guarantee future results. You alone are responsible for your settings, your trading decisions and their results. Read the Risk warning & disclaimer, which forms part of this EULA.
10. No warranty
To the maximum extent permitted by law, the software is provided “as is” and “as available”, without any warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, uninterrupted or error-free operation.
11. Limitation of liability
To the maximum extent permitted by law, the author is not liable for any direct, indirect, incidental, consequential or special loss or damage, including trading losses, lost profits or lost data, arising from the use of or the inability to use the software. Where liability cannot be excluded, it is limited to the price you paid for the license. Nothing in this EULA limits liability that cannot be limited under the applicable law, including liability for intent or gross negligence and mandatory consumer rights.
12. Termination
This license ends automatically if you break this EULA or if the purchase is refunded or charged back. The license key can then be deactivated, and you must stop using and delete the software.
13. Applicable law
This EULA is governed by the law of Hungary. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. If any part of this EULA is invalid, the rest remains in force.
