1. Disclaimer

By visiting ToyamatoForexWorld.com, downloading any file, buying or using any product of Toyamato Forex World (including Toyamato X EA, Toyamato Breakout Zone, Toyamato Helper and Toyamato Account Guardian, together “the software”), you confirm that you have read, understood and accepted this risk warning and disclaimer. If you do not agree, do not download, buy or use the software.

2. High risk of trading

Trading foreign exchange (forex), contracts for difference (CFDs) and other leveraged products carries a high level of risk and may not be suitable for all investors. Leverage can work against you as well as for you. A small market movement can lead to a large loss, and you may lose some or all of your capital, and with some brokers or account types even more than your deposit.

Before you trade, consider your investment objectives, level of experience and risk appetite. Only trade with money you can afford to lose. If you are unsure, seek advice from an independent, licensed financial adviser.

3. Not a holy grail – no guarantee

The software is not a holy grail. No robot, indicator or strategy wins all the time. The software can produce losing trades, losing series, losing weeks and losing months, and can lose the whole account.

There is no guarantee of profit, of any trading result, of any level of performance, of loss prevention or of error-free, uninterrupted operation. Any statement about how the software works describes its intended logic only and is not a promise of any result. Recommended pairs, timeframes and deposits are based on the author's own testing and are not a guarantee.

4. Backtests, demo and hypothetical results

Backtests, optimization results, statistics shown on the indicator panel and demo account results are based on historical or simulated trading. They have inherent limitations: they are made with the benefit of hindsight, they do not reflect real execution, slippage, requotes, liquidity or the emotional pressure of real trading, and they can be over-fitted to the past. Past performance, whether real or simulated, does not guarantee future results.

5. Automated trading and technical risks

Toyamato X EA opens, manages and closes trades automatically. Its grid and martingale modes add trades or increase the lot size while the market moves against the open position, which can lead to large losses in a short time. Stop losses, drawdown limits and other protections reduce risk but cannot remove it; they may fail or be executed at a worse price during gaps, high volatility, news or weekends.

Each copy of the robot needs its own Magic Number. Running the robot on several charts means several baskets can be open at the same time, which increases the risk for the whole account.

Toyamato Account Guardian closes positions only while MetaTrader is running and connected, at the market price, which can be worse than the set limit. It reduces risk but cannot prevent losses.

Results can be affected by your broker (spreads, commissions, swaps, execution, account type, server time), your settings, MetaTrader updates, your computer or VPS, power and internet outages, and errors in the software itself. You are responsible for monitoring your account and the software at all times.

The news filters rely on an economic calendar from a third party (data source nfs.faireconomy.media, as shown on ForexFactory). This data can be wrong, late, incomplete or unavailable, and the filters do not work in the Strategy Tester or if WebRequest is not allowed. The news filter does not protect against unexpected events.

6. No financial advice

Nothing on this website, in the software, in the PDF manuals, in e-mails or on the YouTube channel is financial, investment, trading, legal or tax advice, or a recommendation to buy or sell any financial instrument. I am not a licensed financial adviser and no adviser–client relationship is created. The software is a tool that you install, set up and run yourself on your own account; I do not trade or manage any account for you. You alone are responsible for your trading decisions, your settings and their results.

7. Purchase, license and refund

The paid software is sold through Gumroad, which acts as the seller and handles the payment, the invoice and the applicable VAT under its own terms. The free demos, Toyamato Helper and Toyamato Account Guardian are provided free of charge.

A license is personal and works only on the 2 MetaTrader account numbers (live or demo) that you enter at checkout. These account numbers cannot be changed; a new account requires a new license. The license is tied to the account number, not to a computer. You may not share, resell, publish, decompile or modify the files or the license key. A key that is shared or misused can be deactivated. The robot checks the license key and the account number online; for the indicator the key is entered in the indicator and checked by the free Toyamato Helper, which activates it for 14 days at a time. No support or updates are guaranteed, and the software may be changed or discontinued.

Refund: A 7-day refund applies if the software does not work technically on your MetaTrader (an installation or activation problem that we cannot solve together, or the wrong platform purchased). Trading results and losses are not a reason for a refund – please use the free 10-day demo to test it first. When a refund is issued, the license key is deactivated. Your statutory consumer rights are not affected.

The software is provided “as is” and “as available”, without any warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement, to the maximum extent permitted by law.

8. Limitation of liability and waiver

To the maximum extent permitted by law, the author and Toyamato Forex World are not liable for any direct, indirect, incidental, consequential or special loss or damage, including trading losses, lost profits, lost data or account losses, arising from or in connection with the use of, or the inability to use, the software, this website, the manuals or any information provided. Where liability cannot be excluded, it is limited to the price you paid for the software.

By using the software you agree, to the maximum extent permitted by law, to waive any claims against the author and Toyamato Forex World in connection with your use of the software and your trading results, and you accept full responsibility for that use.

Nothing in this disclaimer limits or excludes any liability that cannot be limited or excluded under the applicable law, including liability for intent or gross negligence, for death or personal injury, or any mandatory consumer rights you may have.

9. Donations

Donations through the “Donate via PayPal” button are entirely voluntary gifts to support the free tools, the YouTube channel and further development. A donation is not a payment for anything and is not connected to any purchase or product. It does not give you any product, license, discount, support, priority, update or other service.

Because a donation is a gift and not a purchase, donations are not refunded, except where the law requires otherwise. If you donated by mistake, contact toyamatoforexworld@gmail.com. Donations are processed by PayPal under PayPal's own terms and are not tax-deductible.

10. Affiliate disclosure

This also applies to this website. In particular, the link to IC Markets is an affiliate link: if you open an account through it, I may receive a commission from IC Markets at no additional cost to you. This does not change the price or conditions you get. The link is not a recommendation or financial advice. Check that the broker is available and properly regulated in your country and read its own terms and risk disclosures. The software works with any MetaTrader 4 / 5 broker, and you do not need to use any affiliate link to buy or use it.

11. Third-party websites and services

This website links to third-party websites and services, such as Gumroad, ForexFactory, nfs.faireconomy.media, PayPal, IC Markets, YouTube. I do not control them and am not responsible for their content, availability, data, terms or privacy practices. MetaTrader is a product of MetaQuotes; Toyamato Forex World is not affiliated with MetaQuotes, Gumroad, ForexFactory, PayPal or IC Markets.

12. Your data

Purchases are processed by Gumroad, which shares with me the data needed to deliver the product and the license (such as your e-mail address, the license key and the 2 account numbers you entered at checkout). When you activate a license, the software sends the license key to Gumroad to check it and compares your account number with the ones stored with your purchase. When you write to toyamatoforexworld@gmail.com, your message is used only to answer you. Your data is not sold or shared with third parties, except where the law requires it. You can ask for your data to be deleted at toyamatoforexworld@gmail.com. This website itself does not use tracking cookies; the third-party services above have their own privacy policies. 13. Your responsibility and local law

It is your responsibility to make sure that trading leveraged products and using automated trading software is legal for you in your country and allowed by your broker. The software is not intended for persons in any country where its use would be against the law.
